LEGISLATIVE ACTION ALERT 

Featured Items: Equal Rights Amendment 

ACTION NOW:
The attorneys general from Nevada, Illinois, and Virginia filed a law suit in Washington, D.C. to ensure that the national archivist carries out his ministerial duties to register the ERA that has now achieved the required ratifications from 38 states. Four other attorney generals who oppose the ERA have filed a motion to intervene in that lawsuit in D.C. and abandon the one they had earlier filed in Alabama since there was no "case or controversy" as required under the Constitution. Those seeking to prevent women from being protected under the Constitution should at least follow it themselves.

A celebration is scheduled for Richmond, VA on March 7th and 8th (International Women's Day). Representatives from the 12 unratified states will be present to continue the work to ensure that all 50 states ratify. March is Women's History Month and AZ could make history by becoming a ratified state - Tell your Senators and two representatives that, especially, McSally (602.952.2410). 

Four opinion pieces were in papers around the state in February. Please continue to educate the public and to write to your local papers in favor of the ERA, both opinion pieces and letters to the editor. Tips for doing both and talking points are on the website.

Our list of supportive businesses grows daily. If you are the owner of a business, please email us to say YES put me on the list and give us the contact info that you want listed. We'll send you a decal for your window so you can make your belief for equality known. If you go to a business, and who doesn't, ask every one you frequent to support the ERA by sending an email with the YES and their contact information. Don't support businesses that don't support you.

A clergy group to support the ERA has been started by an evangelical minister so if you know of any clergy member from any faith who supports, have them contact the ERA Task Force.

UPDATES

Sen. Eddie Farnsworth remains in the news - this time regarding SB1355, the bill that would prohibit rapists from having custody or visitation with any child that was conceived because of the rape.

Some will remember how Farnsworth waxed on in the Senate last year during the ERA debates about how much he honored and loved women and how they should be protected not given equal rights. Now he seems to be siding with rapists over married women (the very ones he wanted to "protect") by insisting that the author of the bill introduce an amendment to exempt married women from it's protections. 

What the law says now in ARS 13-1406, is that sexual assault is defined as: A. A person commits sexual assault by intentionally or knowingly engaging in sexual intercourse or oral sexual contact with any person without consent of such person. It is a class 2 felony with harsher sentences if the victim is below 15. Punishment runs from 5.25 years to 28 depending on whether it’s a first time or repeat offender and other factors. If there is serious physical injury, the sentence could be life.

Raping your wife was not a crime for most of our history. It was assumed under British law that once you married a man, you consented for that man to do whatever he wanted to you and your body which included beating and raping. He took all your money too. Before that, women were considered property of men and they could do as they pleased such as they would a dog or cow including sell them, kill them, or confine them in a mental hospital. It took centuries of work to change the law to include spousal rape.

ARS 13-1407 outlines the defenses for sexual assault: D. It is a defense to a prosecution pursuant to section 13-1404 or 13-1405 that the person was the spouse of the other person at the time of commission of the act. It is not a defense to a prosecution pursuant to section 13-1406 that the defendant was the spouse of the victim at the time of commission of the act.

ARS 13-1404 and 1405 relate to having sexual contact with a minor. But if you are married to said minor, then you have a defense. It does NOT apply to sexual assault in ARS 13-1406.

In spite of the law, Eddie (a lawyer) wants an exception so that married women who are raped by their husbands still must share custody of any child born from that violence. Nice going Eddie. Please let him know how you feel about this: efarnsworth@azleg.gov.
